The Petal View Florist (“we”, “us”, “our”) respects your privacy and is committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 of Malaysia, as amended (the “PDPA”). This Privacy Policy — which also serves as our Personal Data Protection Notice under Section 7 of the PDPA — explains what personal data we collect when you visit our website at www.thepetalviewflorist.com or order from us, how we use and protect it, who we share it with, and the choices and rights available to you. By using our website or placing an order, you acknowledge that you have read and understood this Policy.
Who is responsible for your data: The business responsible for your personal data (the data controller) is The Petal View Florist, Business Registration No. 202003094144 (003102436-V), located at B-2-16, Pusat Komersial Bayu Tasek, Persiaran Southkey 1, Kota Southkey, 80150 Johor Bahru, Johor, Malaysia.
1. Personal Data We Collect
We collect only the personal data we need to provide our products and services to you. Depending on how you use our website, this may include:
- Identity and contact details — your name, email address, and phone or WhatsApp number.
- Order and delivery details — your billing address, the recipient’s name, delivery address and contact number, gift or card message, delivery date, and any special instructions.
- Account details — if you create an account, your username and password (stored in encrypted form).
- Payment information — your payment is handled by our third-party payment provider. We do not store your full credit or debit card or bank account numbers on our website; we receive only confirmation of payment and limited transaction details.
- Information collected automatically — when you visit our website we may collect your IP address, browser and device type, and the pages you view, using cookies and similar technologies (see Section 7).
If you provide us with personal data about another person — for example, the name, address, and contact details of a gift recipient — you confirm that you may share that information with us for the purpose of fulfilling your order.
2. How We Collect Your Data
We collect personal data directly from you when you register an account, place an order, or contact us by phone, WhatsApp, email, or our contact form. We also collect certain data automatically through cookies and similar technologies when you browse our website.
3. How We Use Your Data
We use your personal data to:
- process, fulfil, and deliver your orders;
- manage your account and our relationship with you;
- arrange delivery through our courier partners;
- process payments and help prevent fraud;
- respond to your enquiries and provide customer support;
- keep proper records and comply with our legal, accounting, and tax obligations;
- improve our website, products, and services; and
- where you have agreed, send you news, promotions, and updates about our products.
4. Marketing
We send marketing messages — such as news, promotions, and product updates — only to customers who have agreed to receive them, through a WhatsApp broadcast list. You can opt out at any time by replying to one of our messages to ask to be removed, or by contacting us using the details in Section 12. Opting out of marketing will not affect order-related messages that we need to send you to complete and deliver your order.
5. Disclosure to Third Parties
We do not sell your personal data. We share it only with the following classes of third parties, and only to the extent needed for the purposes described above:
- Payment service providers, to process your payments securely.
- Delivery and courier partners, to deliver your order to the recipient.
- IT, hosting, email, and messaging service providers who support our website and communications.
- Professional advisers such as our accountants or lawyers, where necessary.
- Government authorities, regulators, or law enforcement, where we are required to disclose your data by law.
We require these parties to keep your personal data secure and to use it only for the purposes we specify.
6. Data Retention
We keep your personal data only for as long as necessary to fulfil the purposes set out in this Policy — including completing your orders, maintaining your account, and meeting our legal, accounting, and tax record-keeping obligations. When your personal data is no longer needed, we will securely delete or anonymise it.
7. Cookies and Tracking Technologies
Our website uses cookies and similar technologies to make the site work, to remember your preferences and shopping cart, and to understand how visitors use the site. We may also use analytics tools (such as Google Analytics) and social media features (such as the Meta / Facebook pixel), which set their own cookies. You can control or disable cookies through your browser settings, although some features of our website may not work properly if you do.
8. Transfers Outside Malaysia
We store and process your personal data in Malaysia. Some of the communication and analytics tools we use (for example, WhatsApp) may process certain data on servers located outside Malaysia. Where this happens, we take reasonable steps to ensure that your personal data continues to receive a level of protection consistent with the PDPA.
9. Data Security
We take practical steps to protect your personal data from loss, misuse, unauthorised or accidental access, disclosure, alteration, or destruction. These steps include secure hosting, encrypted connections (SSL), and restricting access to your data to those who need it. However, no method of transmitting data over the Internet is completely secure, and while we strive to protect your personal data, we cannot guarantee the absolute security of information transmitted to or from our website.
10. Your Rights
Under the PDPA, you have the right to:
- access the personal data we hold about you;
- correct or update data that is inaccurate, incomplete, or out of date;
- withdraw your consent to our processing of your data (this may affect our ability to provide services to you);
- object to direct marketing at any time; and
- request data portability — that is, ask us to transfer your personal data to another provider, where this is technically feasible.
To exercise any of these rights, please contact us using the details in Section 12. We will respond to access requests within the time required by law (currently 21 days) and may charge a small prescribed fee for providing access. We may need to verify your identity before acting on your request.
11. Children’s Privacy
Our website and products are intended for adults. We do not knowingly collect personal data from anyone under the age of 18 without the consent of a parent or guardian. If you believe that a minor has provided us with personal data without such consent, please contact us and we will take appropriate steps to remove it.
