These Terms and Conditions govern your use of www.thepetalviewflorist.com (the “Site”) and any order you place with The Petal View Florist (“we”, “us”, “our”). By using the Site or placing an order, you accept these Terms and Conditions. You must be at least 18 years old to order. 1. Products

We describe and picture our products as accurately as we can, but flowers are natural products, so some variation in shade, size, and bloom is normal, and colours may appear differently on your screen.

2. Substitution

As flowers are seasonal and subject to availability, we may substitute any flower, foliage, or container for one of equal or greater value, keeping to the overall style and colour of your chosen arrangement as far as reasonably possible.

3. Prices and Payment

Prices are in Malaysian Ringgit (RM) and, unless stated otherwise, are inclusive of any applicable taxes. Delivery charges, where they apply, are set out in our Shipping Policy. Payment is made in full at the time of ordering, and card payments are subject to authorisation by your card issuer. We may correct any obvious pricing or product error and adjust or cancel the affected order, refunding any amount charged.

4. Your Order

When you place an order you are making an offer to purchase, and a contract is formed only once we confirm acceptance. We may decline or cancel an order — for example, if an item or delivery slot is unavailable, the address is outside our coverage area, or payment is not authorised — and will refund any amount already paid.

5. Delivery

Delivery is arranged in accordance with our Shipping Policy. You are responsible for giving us complete and accurate recipient details, and risk passes to you on delivery to the recipient or the delivery address.

6. Cancellations, Refunds, and Quality

Cancellations, refunds, and our quality guarantee are covered by our Return & Exchange Policy. As our products are perishable and made to order, returns and change-of-mind cancellations are limited, but a quality guarantee applies if your order is faulty, damaged, incorrect, or not as described.

7. Privacy and Marketing

We handle your personal data in accordance with our Privacy Policy. We only send marketing messages where you have agreed to receive them, and you can opt out at any time.

8. Using the Site

All content on the Site is our intellectual property or used under licence, and may not be copied or reused without our permission. You agree to use the Site lawfully, to keep your account details secure, and to be responsible for any content you submit. Any third-party links are provided for convenience and are used at your own risk. We may suspend or end your access if you breach these Terms and Conditions.

9. Liability

The Site and its contents are provided on an “as is” basis. Nothing in these Terms and Conditions removes your statutory rights as a consumer under Malaysian law, including the Consumer Protection Act 1999. Subject to that, our total liability for any order is limited to the price paid for it, and we are not liable for delays or failures caused by events beyond our reasonable control.

10. Changes and Governing Law

We may update these Terms and Conditions from time to time, posting the updated version here with a revised “Last updated” date. These Terms and Conditions are governed by the laws of Malaysia and are subject to the jurisdiction of the Malaysian courts.
